CLASSIC-CAR-WORLD LTD - TERMS AND CONDITIONS OF SUPPLY

1. Introduction
1.1 These Terms and Conditions, together with any applicable Contract, shall apply to all orders for the supply of Tools and Services by Classic-Car-World Ltd to the Customer to the exclusion of all other terms and conditions, including any terms or conditions which the Customer purports to apply under any purchase order, confirmation of order, specification or other document.

1.2 Any variations of these Conditions shall have no effect unless expressly agreed in writing and signed on behalf of Classic-Car-World Ltd. Classic-Car-World Ltd may change these Conditions or the Contract from time to time by giving two weeks notice. Such notice will be promulgated on our website or by direct communication with our registered members as is appropriate.

1.3 For the avoidance of doubt any purchase orders placed will be accepted on the basis of Classic-Car-World Ltd’s Conditions and not the Customer’s.

2. Definitions
In these terms and conditions the following words have the following meanings:

2.1“Charges”: means the charges for the Services as specified on our website and as may be varied from time to time in accordance with clause 9.

2.2 “Conditions”: means the standard terms and conditions for the Supply of Services as described herein.

2.3 “Confidential Information”: means any and all information which relates to the business affairs, products, developments, trade secrets, know-how, personnel, clients and suppliers of either party or information which may reasonably be regarded as the confidential information of the disclosing party.

2.4 “Customer, you,your”: means the person, firm or company who makes use of or has become a registered user of the Classic-Car-World Ltd website.

2.5 “Classic-Car-World Ltd, we, us, our”: means Classic-Car-World Limited (registered number 3930761) whose registered office is at 32 Washingborough Road, Heighington, Lincoln, LN4 1RE.

2.6 “Force Majeure”: means any cause affecting the performance by a party of its obligations arising from acts, events, omissions, or happenings beyond its reasonable control. Including (but not limited to) wars, riots, embargoes, strikes, lockouts, acts of god, insurrection, or civil commotion or any other causes or circumstances beyond the party’s reasonable control.

2.7 "Guidelines": means the guidelines we may publish from time to time regarding your use of the Service.

2.8 "Service" the information we make available and service provided by us from time to time, details of which are set out in the Website.

2.9 "Website" the website operated by Classic-Car-World Ltd. These include and are not limited to: www.classic-car-world.co.uk, www.classic-car-world.com, www.ccw-tools.co.uk, www.ccw-tools.com, www.amp-starters.co.uk or any other web site which we may operate from time to time.

3. General
3.1 These terms and conditions are the only conditions under which we are willing to provide the Service to you. These conditions can only be modified as set out in these conditions or by a variation in writing signed by a director of Classic-Car-World Ltd.

3.2 We will from time to time publish Guidelines on the use of the Service, which we will notify to you. The Guidelines are in addition to and are deemed to form part of these terms and conditions.

3.3 Classic-Car-World Ltd reserves the right to change these Terms and Conditions or the Contract from time to time by giving two weeks written notice. Notification of such changes will also be mentioned on our website or directly to you.

3.4 These terms and conditions (including any documents referred to within them) contain all the terms on which we provide the Service to you. They supersede any prior promises, representations (except fraudulent misrepresentations), undertakings or implications made.

3.5 Where you are a private consumer, nothing in these terms and conditions exclude or limit your statutory rights.

4. Prices & Payment
4.1 We must receive payment for the whole of the price of the goods we supply to you before delivery unless we have agreed otherwise in advance in writing.

4.2 Our Terms for manual invoices on all off-line account transactions is strictly 14 days from the date of invoice. All outstanding balances after this date will be charged at 8% above the current bank base rate on a daily basis plus a daily admin fee of £20 for each day the account is overdue.

4.3 VAT @ 20% is currently included on the prices shown.

5. Delivery Charge Details.
5.1 Delivery charges are calculated during the checkout process and are based on the delivery location and on the weight of the consignment. An estimate of the delivery cost can be seen in the shipping estimator within the shopping basket. By default this displays UK Mainland delivery charges but other regions and countries can also be selected. All orders over £75, either as a single item or as a combined order, will be carriage free within the UK Mainland postcode regions only excluding Highlands & Islands postcode regions, NI, Channel Islands and Off Shore Islands. This applies to our standard UK Mainland delivery option only and does not include any of our express or next day delivery services.

5.2 *Please note that under certain circumstances additional delivery charges may apply for deliveries to the outlying Highlands and Islands of Scotland. Also, delivery to outlying areas will be ONLY by special agreement with our Customer Services department. 5.3 The most cost efficient shipping method will be used when sending your purchase.

5.4 Overseas orders. Carriage charges are calculated on the weight of the consignment however for overseas orders there may be an additional charge applied if the items are large or bulky. Carriers will calculate the weight based on the physical dimensions of the complete order, known as the volumetric weight, as opposed to the actual weight of the consignment. In these cases there may be an additional carriage charge to pay before the order can be dispatched. We will always contact you and confirm the carriage cost before dispatching your order if an additional payment is required.

6. Dispatch and Delivery Schedule
6.1 All orders are normally processed and dispatched on the same day the order is received providing the order is received before 3:00pm. Orders received after this time will be processed on the next business day. Our standard delivery terms are between 3 & 5 working days for all items which are in stock. Out of stock items are typically available within 7 working days, and will be dispatched once they have been received from the manufacturers. Our customer service department will contact you if we foresee any delays beyond this. You will always be offered the option to continue to wait or to cancel the out of stock item and receive a refund for this item. The remaining part of your order will be dispatched in the normal manner.

Please note that all orders are dispatched directly from our suppliers. In the case where an order is being fulfilled by different suppliers, you order may arrive in separate packages.

6.2 Verification of customer details. Classic-Car-World Ltd reserves the right to contact all customers to confirm their identity, order and delivery details at any time. In the interests of security we will always contact ALL customers where the delivery address supplied is different to the address registered for the credit card or where the delivery schedule has been requested for a next day. If we are not satisfied that the details cannot be verified we will refuse to dispatch the order until three separate forms of identity has been provided. This may be in the form of a copy of a driving license or passport and a copy of a utility bill from the registered address and showing the customers details.

7. Cancellation / Returns
7.1 All deliveries should be inspected when received and any faulty goods should be notified to Classic-Car-World Ltd within 48 hours of receipt. All faulty items will be replaced on a like for like basis within 7 working days from receipt (subject to proof of purchase and notification to Classic-Car-World Ltd of your intention to return the goods).The faulty or damaged item should be collected at the same time if possible.
In accordance with the Sale of Goods Act 1979 (as amended) consumers may also return goods which do not conform to the contract for a full refund at any time subject to confirmation from Classic-Car-World Ltd. Wherever possible we will endeavour to supply replacement goods which meet the declared specification.

7.2 All products are covered by a minimum 12 month manufacturers warranty (6 months on spare parts) covering both faulty materials and faulty workmanship, it does not cover general wear and tear or damage to the product.

7.3 Please note that we cannot be held responsible for lost returns so please ensure you return them via an appropriate courier or insured method as we do not accept any liability until received by us.

7.4 Goods should be returned in their original packaging where possible, with adequate protection to ensure that the goods and packaging reach us in good condition.

7.5 Where an order is placed under special delivery arrangements any delivery charge is non refundable in the event of a return for any reason.

7.6 The consumer has the right to cancel or return their order / purchase within 14 working days from receipt of the original order / purchase without giving a reason, subject to the goods being unused in original packaging and in a re-saleable condition.

7.7 If you have notified us of a problem with the goods, we will (at your option) either make good any shortage or non-delivery, replace or repair any goods that are damaged or defective upon delivery, refund to you the amount paid by you for the goods in question. The original delivery charge is not included in any refund made for returned or cancelled orders if the have already been delivered as instructed.

7.8 We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss of damage or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.

7.9 Refunds Policy
Trade
All trade orders which have been incorrectly placed and delivered to you will subject to a minimum £5 or 20% handling charge, whichever is greater. The goods are to be returned to our suppliers in "as new" condition at your cost. Please contact us for return address details. All damaged or non-functional items will be collected and replaced on a next day basis subject to availability.
Retail
All Retail orders which have been incorrectly placed and delivered to you can be returned to our Lincoln address for a full refund, excluding any express delivery charges, in accordance with the Distant Selling Rules. The goods are to be returned in "as new" condition at your cost. Please contact us for return address details. All damaged or non-functional items will be collected and replaced on a next day basis subject to availability.

Refunds for returned items are made within 7 working days and after verification from the respective suppliers that the good have been received and are in the stated condition. All refunds up to the total value of the original order (excluding initial delivery charge) can only be made to customers credit / debit card or PayPal account used for the original order.

8. Guarantees and Warranties
All tools and equipment supplied by Classic-Car-World Ltd are supplied with a comprehensive 12 month manufacturers warranty. Spare parts normally carry an 6 month warranty, please contact to check on individual spare parts. All guarantees, warranties and assistance from Classic-Car-World Ltd are offered in addition to your statutory rights as a consumer.

9. Complaint Handling Procedure
The Company endeavours to respond to complaints within 5 working days. We always endeavour to handle complaints fairly and swiftly. Keeping the customer informed about progress. 10. Disclaimer
10.1 The consumer’s statutory rights are not excluded or limited in any way in accordance with the Sale of Goods Act 1979 (as amended).

10.2 Please note that when you submit your order, the order response process is completely automated, so that you will receive an automatic order placement confirmation and payment will be taken automatically as well. However, we will then send you another email to confirm whether or not we have accepted your order, after checking stock availability and pricing.

Although we use reasonable endeavours to enter pricing correctly on our website, we check the pricing when we receive an order from you. If due to a typo or malfunction, the incorrect pricing has appeared on our website, we will decline your order and inform you of this fact, together with details of the correct pricing, and we will also refund your payment. We will on becoming aware of any incorrect pricing, immediately put in place arrangements for our pricing to be updated on our website.

10.3 Price and availability information is subject to change without notice. Except as specifically stated on this Web site, to the fullest extent permitted at law, neither Classic-Car-World Ltd nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this Web site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. 10.4 All purchasers are required to be 18 or over and have printed out and read in full and accepted our full terms, conditions and disclaimer before products are dispatched.
10.5 Whilst using garden tools, powered machines, power tools, and forestry equipment etc., you must be wearing the correct safety equipment AT ALL TIMES. Protective clothing/equipment is available on our website and at other retail outlets. Follow manufactures recommended safety tips. Keep your tools and equipment well maintained and serviced regularly. When appropriate, use outdoors or in a well ventilated room.
10.6 Anyone who uses a chainsaw should have received adequate training in safe use. Wear suitable protective equipment (available on our website or at other retail stores). And ensure they have taken all reasonable practical steps so that no-one is put at risk by their work. Before a chainsaw is dispatched you are required to download, read and accept our Terms, Conditions and Disclaimer and check box to confirm acceptance.

11. Force Majeure.
We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including without imitation act of God, strikes, and other industrial disputes).

11.1 Governing Law and Contract Information
No contract will subsist between you and Classic-Car-World Ltd for the sale by it to you of any product unless and until Classic-Car-World Ltd accepts your order by email confirming that it has been processed. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Classic-Car-World Ltd sends the email to you (whether or not you receive that email). For the avoidance of doubt, any such contract will be deemed to have been concluded in the United Kingdom. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England, and you and Classic-Car-World Ltd irrevocably submit to the non-exclusive jurisdiction of the English Courts.

12.1 We at Classic-Car-World Ltd respect your rights as a consumer. Classic-Car-World Ltd is dedicated to protecting your privacy to the full extent of the UK data protection acts of 1984 and 1998 and according to the SafeBuy Code of Practice.

13. 3rd party disclosure
13.1. We use eKomi as an independent provider of our review process. To enable this we pass the customer e-mail address and order ID only to eKomi so that eKomi can link any reviews to orders placed on our website and to request your feedback on the service we offer. This is to ensure our reviews are only provided by real customers and that these reviews and open & honest and can not be altered by us in any way. The use of customer details are strictly managed and the use of these details are for our feedback purposes only.
13.2. Classic-Car-World Ltd will never trade, sell or exchange any of your personal details with any 3rd party company or institution, for commercial purposes unless you specifically give your permission at the point of data entry.
13.3. Website statistics may be provided to reputable 3rd party vendors, but this will NEVER contain any personal details. We will not e-mail you in the future unless you have given us your consent.

14. Cookies
The shopping cart section of this website uses a cookie to track you entering and leaving the checkout area, this is done to ensure that each cart remains totally separate. No shopping, personal or payment details are stored in the cookie, and the cookie will automatically expire after a short fixed period of time.
